A Milestone in DIFC Courts: The First-Ever Mediation Session

8 October 2025 · Jose Joseph · 3 min read

The DIFC Courts have marked a new chapter in commercial dispute resolution with the successful conduct of their very first mediation under the newly established Mediation Centre. We had the privilege of being part of this landmark moment, representing our client in a matter that was originally filed before the Court but ultimately resolved through mediation.

What could have taken many months of litigation—and perhaps stretched over a year—was brought to an end in just one day of structured mediation. This outcome not only delivered speed and cost savings but also preserved critical business relationships that might otherwise have been strained through prolonged proceedings.

Why This Development Matters

From Courtroom to Mediation Table The case had already entered the Court system, but we advised our client to consider mediation as an alternative. This was not just about efficiency—it was a strategic choice to unlock a faster, more constructive outcome. The result validates the wisdom of that approach.

Proof of Concept: Mediation in Action This first case demonstrates that mediation within the DIFC framework is not a theoretical option—it is a working, effective mechanism. In complex commercial disputes, having the ability to pivot from adversarial proceedings to cooperative problem-solving can be game-changing.

Strategic Advice, Tangible Value: Convincing parties to step away from litigation requires trust in both the legal team and the system. Here, that trust paid off, with mediation proving to be the most pragmatic and fruitful path forward.

The Bigger Picture: Why Mediation is Gaining Ground

Speed – timelines are reduced from many months or years to weeks, sometimes even a single session.

Cost Savings – less procedural expense and fewer drawn-out hearings.

Preserving Relationships – businesses can settle disputes without burning bridges, keeping collaboration alive for the future.

The success of this first mediation shows that the DIFC Courts are not only world-class adjudicators but also forward-looking innovators in dispute resolution. For businesses navigating high-value, cross-border disputes, mediation now offers a proven alternative that combines efficiency with commercial sensibility.

We acknowledge with gratitude the efforts of our dispute resolution team—Asha Bejoy, Sudha Sampath, Jose Joseph, Jerome Jose, Aeron Thomas, Milen Zacharia, and Mathew Jones—who shared in this historic moment alongside the DIFC Courts.

Looking Ahead

This first successful mediation is more than a milestone—it is a sign of what’s to come. As global business becomes more interconnected and time-sensitive, mechanisms like the DIFC Mediation Centre are poised to become the go-to option for companies seeking fast, business-oriented resolutions. The ability to resolve disputes in days rather than years, while preserving commercial relationships, will be a decisive advantage for businesses operating in the region and beyond.
