Abu Dhabi Government Prohibits Use of Official Emblem on Commercial Products: What Businesses Need to Know

The Abu Dhabi Department of Economic Development (ADDED) has issued a circular prohibiting the use of the Abu Dhabi Government emblem on commercial products and services without prior authorization. This directive is in line with Law No. (5) of 2010, which governs the use of the Emirate’s official emblem. 

The circular emphasizes that the emblem cannot be used for any purpose unless explicit approval is obtained from the relevant authorities. The measure aims to protect the exclusivity of the government’s identity and prevent any potential confusion arising from unauthorized use. 

What Does the Regulation Cover? 

The prohibition applies to all forms of commercial products and materials, including but not limited to: 

  • Product or service-related materials such as product packaging, product/service labels, etc. 
  • Marketing and advertising content such as digital advertising, printed materials (brochures, flyers, posters), billboard and signage, etc. 
  • Promotional merchandise such as corporate gifts, event branding, etc. 
  • Digital platforms such as on websites and mobile phones, email signatures, etc. 
  • Documents from and of the Business such business cards, invoices and receipts, etc. 

How Can Businesses Ensure Compliance? 

To avoid penalties and/or other action by the authorities, businesses should: 

  • Reviewing all branding, marketing materials, and product designs to ensure they do not include the Emirate of Abu Dhabi’s emblem. 
  • Seek legal counsel if there is uncertainty about compliance to the notification; 
  • Ensure all future designs and promotional efforts exclude the emblem unless explicit approval is obtained from the authorities as notified. 

Can Businesses Obtain Approval for Use? 

Yes, business can obtain approvals in certain cases, but the approval/authorization must be taken prior to any use of the emblems. Bona fide applicants could potentially be joint ventures between both the private and government entities, and Public Private Partnership (PPP) companies. ADDED is yet to clarify further what other type of companies and establishments can apply for the approval to use the emblem.

  • Assist in obtaining regulatory approvals for emblem use. 
  • Develop internal policies to prevent non-compliance.

Enforcement measures 

To enforce compliance, ADDED will conduct inspection campaigns across business establishments in Abu Dhabi. Businesses found violating the directive will face legal consequences in accordance with established procedures. 

This latest move reflects Abu Dhabi’s commitment to preserving the integrity of its governmental identity by ensuring the proper use of official symbols. It underscores the importance of maintaining a clear distinction between government and private sector identities, promoting fair practices while safeguarding the exclusivity of government emblems. Businesses are urged to review their practices and materials to ensure full compliance with the circular.
