  • Exclusions: Inventions contrary to public order, scientific theories, business methods, and medical treatments are non-patentable. 

The UAE’s patent system is governed by Federal Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights.

Choosing the Appropriate Filing Route 

There are two main routes to filing a patent in the UAE: 

  • PCT Application: For those seeking protection in multiple countries, the UAE acts as a PCT member. 

Filing the Patent Application 

Step 1: Online Registration 

The UAE Ministry of Economy provides an online portal for filing patent applications. Create an account and select the relevant service for patent registration. 

Step 2: Submission of Required Documents 

The application must include: 

    • Patent specification (in Arabic and English). 
    • Abstract of the invention. 
    • Claims defining the invention’s scope. 
    • Drawings or diagrams. 
    • Power of attorney (if filing through an agent). 
    • Payment receipt of the application fees. 

Step 3: Payment of Fees 

Application fees vary based on the complexity of the invention. Ensure timely payment to avoid delays.

Once the application is submitted, it undergoes a rigorous examination process: 

Formal Examination

The MoE verifies that the application meets all procedural requirements. 

Substantive Examination

A detailed evaluation determines the novelty, inventive step, and industrial applicability of the invention. This stage may involve interactions with the examiner, including answering queries or making amendments to the application. 

Publication of the Patent Application 

After a successful examination, the application is published in the official gazette. This allows the public to review the invention and raise objections, if any. 

  • Opposition Period: Interested parties have six months to file objections. 
  • Handling Objections: The applicant can respond to objections or amend claims to address concerns. 

Granting of the Patent 

If no objections are raised or resolved, the patent is granted. The Ministry of Economy issues a certificate of registration, officially granting exclusive rights to the invention. 

  • Duration of Protection: The patent is valid for 20 years from the filing date, provided annual renewal fees are paid. 

Post-Grant Requirements 

Annual Maintenance Fees: 

  • Patents require yearly renewal to remain in force. Non-payment leads to lapsing of rights.
